New Clients – First Appointment
Your first consultation will be approximately 60 minutes. During this time your practitioner will take notes about your health history, suggest the appropriate lab tests you should order to address your specific health concerns and make some recommendations for you regarding diet, rest, exercise and stress reduction. Should we find out prior to the appointment that this program is not suitable for you, a full refund will be provided.
Purchasing Products & Services
Appointment fees are as outlined on the website (emmaclairenutrition.com.au) and are current as at the time of booking. Payment is due at the time of booking via one of the following payment methods: Visa, MasterCard or Direct Debit. By placing an order via the Website, you are offering to purchase Products and/or Services (as applicable) from Emma Bambling subject to these Terms and Conditions. Each Order you place will be a separate and binding contractual agreement between you and Emma Bambling and with respect to the supply of the Products and/or Services in accordance with these Terms and Conditions. You agree that Emma Bambling reserves the right in its sole discretion to accept or reject an Order, and that Orders are subject to availability of the relevant Products and/or Services.
All prices are quoted in AUD and are subject to change without further notice, if you are signing up for a program your price remains as per the time of purchase.
All prices are inclusive of GST (unless otherwise stated).
The User hereby understands in choosing to purchase a month to month program package on the Website he/she is responsible for on-going monthly payments in the outlined time frame; 12 weeks. We will follow up on any missed payments twice within the fortnight of the missed payment and reserve the right to send any owed fees to a debt collection service after one month.

If you need to cancel or reschedule an Appointment, you must provide Emma Claire Nutrition with 36 hours notice, otherwise you will permanently forfeit the right for Emma Claire Nutrition to provide the purchased Services. If purchased services are not used within 9 (273 days) months of purchase date, you forfeit the right to use them.
Delivery of Products & Services
For Services that are purchased on emmaclairenutrition.com.au, you may be required to schedule an appointment with Emma Claire Nutrition for provision of the purchased Services (“Appointment”). If that is the case: You can schedule an Appointment by emailing hello@emmacalirenutrition.com
If you need to cancel or reschedule an Appointment, you must provide Emma Claire Nutrition with 36 hours notice, otherwise you will permanently forfeit the right for Emma Claire Nutrition to provide the purchased Services. If purchased services are not used within 9 (273 days) months of purchase date, you forfeit the right to use them.
Appointments
Follow-up consultations may be scheduled in 30 - 45 minutes. We encourage you to book your appointment 1-2 weeks in advance. As a courtesy to you, you will receive an appointment reminder via email to remind you of your scheduled appointment.
Lab Tests
If you do not have a follow up consultation scheduled and lab results are received, you will be contacted and asked to schedule a follow up consultation. At any time you have the right to request a copy of your lab results, please allow for a reasonable response time from Emma Claire Nutrition.
Rescheduling by Provider
If we need to reschedule your appointment, we will endeavour to provide as much notice as reasonably possible and require you to select an alternative appointment time. If you decide to not reschedule, the Cancellations and Refunds policy will apply.
For all other appointment types, if you are unable to keep your scheduled appointment, you can reschedule your appointment via the online booking tool at any time up until 36 hours before your appointment without charge. If you fail to reschedule your appointment within the required notice period, the Cancellations and Refunds policy will apply.
Rescheduling by Client
For Initial Consultations, you may request to reschedule your appointment date and time a minimum of 48 hours prior to your appointment to receive a full refund, minus any transaction fees. For those who reschedule under 48 hours in advance there will be no refund.
For all other appointment types, if you are unable to keep your scheduled appointment, you can reschedule your appointment via the online booking tool at any time up until 36 hours before your appointment without charge. If you fail to reschedule your appointment within the required notice period, the Cancellations and Refunds policy will apply.
Cancellations and Refunds
If you are unable to keep your scheduled appointment and do not wish to reschedule, you must cancel your appointment via the online booking tool or notify us via email a minimum of 48 hours before your scheduled appointment time to receive a full refund, minus any transaction fees. If you fail to cancel your appointment with the required notice, you will forfeit your booked appointment and any cost already incurred and will not be eligible for a refund.
The User hereby understands in choosing to purchase either the 12 Week Personalised Health Program or follow up consultations on the Website he/she is responsible for completing the program content.
Consultations and Programs at Emma Claire Nutrition are non-transferrable.
Missed appointments
We understand that there can be a rare occasion where you miss your appointment altogether or you forget to let us know at least 48 hours in advance that you need to reschedule. As such, for those on a monthly follow-up support package or subscription, you are allowed 1 “Get Out of Jail Free” when you’ve missed an appointment. For all other bookings, missed appointments will result in forfeiting your booked appointment and any cost already incurred and will not be eligible for a refund.

ensure you have a reliable and sufficient internet or phone connection or reception;

Failure to follow these instructions may result in forfeiture of your appointment time and fee.
Technology – Zoom Appointments (both Australian Domestic and International)
A Zoom meeting will automatically be created when an appointment(s), is scheduled. It is your responsibility to ensure it is downloaded and tested prior to your appointment(s). If you are unable to access Zoom for your appointment, please email hello@emmaclairenutrition.com and alternate arrangements can be made. Failure to follow these instructions may result in forfeiture of your appointment time and fee. For Zoom meetings you will receive the appointment link at the time of booking, this is also located in reminder emails and it is your responsibility to attend this at your appointment time.
Intake Forms
You are required to complete your consultation documents or other requested documents within 24 hours of your scheduled appointment, we will not be able to proceed with your appointment and you will need to reschedule. If so, the Rescheduling by Client and Cancellations and Refunds policies will apply.
Time Zone Differences
All appointments are made and will transpire using the Australian Eastern Time Zone (UTC +10:00). If you do not reside in this time zone, it is your responsibility to ensure you select the correct time zone in the booking tool and accurately convert the time change so as to not miss your appointment(s). http://www.timeanddate.com/ Failure to ensure an accurate time zone conversion will result in forfeiture of your appointment time and fee.
Governing Law
The validity, interpretation and construction of this Agreement shall be governed and construed in accordance with the laws of the State of Queensland, Australia with the sole jurisdiction and venue of any dispute being Brisbane, Queensland. The Client further agrees to be bound by the laws in Queensland even if the country’s laws in which the Client resides are in conflict with the laws of Queensland in accordance with the Hague Act and related statutes.
Other Documents
These terms and conditions are to be read in conjunction with our Privacy Policy as well as the Informed Consent and Disclaimer signed before becoming a Client.
For Products and client resources purchased via the Website or emailed to you (the client or customer), you will have a non-exclusive, non-transferrable and non-assignable right to view and use the Products, and for Products obtained through digital download via the Website, display one copy of the Products on a device of your choosing, for private, domestic and non-commercial purposes only.
Intellectual Property
The Intellectual Property in the Website and all Content (“Website IP”) and Products (“Products IP”) is exclusively owned and controlled by Emma Claire Nutrition and our third party affiliates, licensors and/or licensees and is protected by Australian and international law governing intellectual property rights. The Website IP and Products IP remains Emma Claire Nutrition’s exclusive property throughout the world in perpetuity. You are not permitted to save, download, reproduce, display, copy, alter, conceal, adapt, perform, transmit, broadcast, sell, license or otherwise exploit any Website IP unless you have the express prior written authorisation of Emma Bambling.

Subject to the application of any Non Excludable Conditions, Users hereby release Emma Claire Nutrition from all claims and Emma Claire Nutrition is not responsible nor liable for any injury, illness, direct or indirect damage, loss (financial, reputation or otherwise) or consequential, exemplary or aggravated damages arising from:
your use of, or inability to use, the Website;
any failure by Emma Claire Nutrition offer other third parties to provide any information, service, feature or functionality via the Website; and
your use of, or reliance on, the Products, Services or Content;
any User Content that is created, or otherwise appears, via the Website;
any failure by Emma Claire Nutrition offer other third parties to provide any information, service, feature or functionality via the Website; and
your use of third-party services (including any sharing to third-party websites) in conjunction with the Website.
Users hereby acknowledge and confirm that they are on notice of Emma Claire Nutrition’s disclaimer of warranties and limitation of liability set forth in this clause or elsewhere in these Terms and Conditions (“Disclaimers & Limitations”) and expressly agree to these Disclaimers and Limitations as a condition of using the Website.
